Debit note under GST: when to issue and ITC rules

A GST debit note is issued by a supplier when an invoice understated value or tax. It raises the supplier's liability and the buyer's credit.

Short answer

A debit note under GST is a document issued by a registered supplier under section 34(3) of the CGST Act, 2017 when the taxable value or tax charged in an invoice is lower than it should be. It increases the supplier's output tax liability and allows the recipient to claim the additional input tax credit, subject to the usual conditions.

When a debit note is issued

A debit note corrects under-billing. It is typically issued when a price escalation clause applies after supply, when additional quantity is supplied against the same invoice, or when tax was charged at a lower rate than applicable. The debit note must contain the details required by the invoice rules, including a reference to the original invoice. It is reported in GSTR-1 for the month in which it is issued, and the extra tax is paid with that month's GSTR-3B.

Input tax credit on debit notes

The recipient can claim credit for tax shown on a debit note once it appears in GSTR-2B and the other conditions under section 16 are met. Following an amendment effective from 2021, the time limit for claiming such credit is linked to the financial year in which the debit note is issued, not the year of the original invoice. This helps where price revisions happen long after the original supply.

Why it matters for startups

Contracts with price escalation, usage-based billing true-ups or revised rate cards often need debit notes. Issue them as soon as the revised amount is known, pay the extra tax in that month, and share them with customers promptly so they can claim credit. Using a fresh invoice instead of a debit note can confuse customers' reconciliations.

Common questions

What is the difference between a debit note and a credit note?

A debit note increases the taxable value or tax on an earlier invoice. A credit note reduces it.

Can a buyer issue a debit note under GST?

Buyers sometimes issue commercial debit notes, but under GST, the supplier's debit note under section 34(3) is what affects tax liability and credit.

Is there a time limit for issuing a debit note?

GST does not set a strict deadline for issuing debit notes, but interest may apply if extra tax was payable earlier.
