How to start a gym or fitness studio in India: registrations and licences
Gym and fitness studio licences in India: GST cut to 5% without credit, trade and health licence, fire NOC, music licences and member data rules.
Short answer
A gym or fitness studio in India needs a business entity, a shop and establishment registration, a municipal trade or health licence and a fire NOC where the building and capacity require it. Playing recorded music needs licences from rights holders. From 22 September 2025, gym, health club and yoga services attract 5% GST without input tax credit, down from 18%.
- GST on gym and fitness services
- 5% without input tax credit
- Previous rate
- 18% with credit, until 21 September 2025
- Local licences
- Trade or health licence, fire NOC
- Music
- Public performance licences needed
- Supplements or cafe
- FSSAI registration
Choosing a structure
A single studio run by a trainer can begin as a proprietorship. Gyms with costly equipment, leases and staff are better as LLPs or private limited companies, which also make it easier to raise funds or sign franchise agreements with national brands.
If you take a franchise, the franchisor's brand licence does not replace your own registrations. Each outlet needs its own local licences and GST registration in its state.
Licences for a gym or studio
Most permissions are local. Large gyms in commercial buildings face more fire and building scrutiny than small studios. Check whether your building's occupancy certificate permits a gym before signing the lease, since heavy equipment and crowds raise structural and fire questions.
| Licence | Issuing authority | When required | Typical validity |
|---|---|---|---|
| Shop and establishment registration | State labour department | Most states | Varies by state |
| Trade or health licence | Municipal corporation | Most cities | Usually annual |
| Fire NOC | State fire service | Depends on building, area and occupancy | Varies |
| GST registration | GST department | Above ₹20 lakh services turnover | Until cancelled |
| Music licences | Copyright owners or their agents | Playing recorded music in classes or the floor | Usually annual |
| FSSAI registration | FSSAI | Selling supplements, shakes or food | 1 to 5 years |
| Signage permission | Municipal body | External boards | Varies by city |
How the 2025 GST change affects gyms
Beauty and physical well-being services, including gyms, health clubs, fitness centres and yoga, moved from 18% with input tax credit to 5% without credit on 22 September 2025. Membership fees are cheaper for customers, but the gym can no longer claim GST paid on rent, equipment or maintenance as credit.
Review your pricing and cost structure. Equipment purchased after the change carries GST that becomes a cost. Supplements and merchandise sold at the counter are goods and taxed at their own HSN rates, with credit available on those purchases.
Member contracts and data
Membership terms should clearly state fees, freezing, cancellation and refund rules, and the waiver and medical declaration you require before training. Unclear refund policies are a frequent source of consumer complaints against gyms.
Gyms collect personal data such as health conditions, body measurements and biometric attendance. Under the DPDP Rules 2025, duties such as notices, security safeguards and breach reporting apply from 13 May 2027. Collect only what you need and secure it properly.
Ongoing compliance
Renew trade, health and fire licences on time and maintain equipment safety logs. Trainers and staff on payroll bring ESIC obligations at 10 employees and EPF at 20, plus professional tax where levied.
File GST returns, deduct TDS on rent above the prescribed threshold and on payments to freelance trainers, and file annual returns for your entity. Renew music licences annually.
Personal trainers, classes and online coaching
Decide whether trainers are employees or independent contractors and document it. Employees come under wage, social security and professional tax rules; freelance trainers invoice you, and you deduct TDS on their fees where required. Revenue-sharing arrangements should be in writing to avoid disputes.
Online classes and app-based coaching are also fitness services for GST purposes when sold to Indian customers. If you sell programmes to overseas customers, export of services rules may apply, which allows zero-rating with a Letter of Undertaking if you are registered.
Pitfalls for gym owners
Small compliance gaps, like an expired trade licence or missing fire extinguishers, are common inspection findings, so assign one person to track renewals. Put renewal dates in a shared calendar with reminders.
- Continuing to charge 18% and claim credit after the September 2025 change.
- Playing commercial music without licences.
- Selling supplements without FSSAI registration.
