How to Register a Trademark in India: From Search to Certificate

Trademark registration in India step by step: search, classify, file TM-A (₹4,500 or ₹9,000 a class), examination, journal, opposition and certificate.

Short answer

Search the trademark register, choose the right class, and file Form TM-A online for ₹4,500 per class (individuals, startups and small enterprises) or ₹9,000. The registry examines the mark; reply to any objection within one month. Once accepted, it is advertised in the Trade Marks Journal for four months of opposition. If unopposed, the mark is registered for ten years and renewable.

Step 1: search and choose classes

Search the IP India public search for identical and similar marks in the classes you need, including phonetic variants. The Nice Classification has 45 classes: 1 to 34 for goods and 35 to 45 for services. A software startup may need classes 9 and 42, and a consumer brand may also need class 35. Draft a precise description of your goods or services instead of claiming entire class headings.

Step 2: file Form TM-A

File online with the applicant's details, the mark, class, description and use claim. Individuals, DPIIT-recognised startups and small enterprises with Udyam registration pay the lower fee. An application number is generated immediately, and you can use the ™ symbol from then on.

ApplicantE-filing fee per class
Individual, startup, small enterprise₹4,500
Others (companies, LLPs not qualifying)₹9,000

Step 3: examination and objections

An examiner checks the application for absolute grounds (section 9, such as descriptiveness or lack of distinctiveness) and relative grounds (section 11, conflict with earlier marks). If there are objections, an examination report is issued and you must reply within one month. If the reply is not accepted, a show cause hearing is scheduled. Failure to reply can lead to the application being treated as abandoned.

Step 4: advertisement and opposition

Accepted marks are advertised in the Trade Marks Journal. Anyone can file a notice of opposition within four months of publication. If opposed, you have two months to file a counter-statement, after which both sides file evidence and the matter is heard. Opposition can add a year or more to the process.

Step 5: registration and renewal

If there is no opposition, or it is decided in your favour, the registry issues a registration certificate and you may use the ® symbol. Registration lasts ten years from the application date and can be renewed indefinitely for further ten-year periods. Record any later change of name, address or ownership with the registry.

  • Diarise the renewal date ten years from filing
  • Record assignments when transferring the mark
  • Use the mark consistently to avoid non-use cancellation
  • Monitor the journal for conflicting marks

Timeline and costs

Government fees are charged per class, so a brand registered in three classes pays three times. Professional fees for search, filing and objection replies are extra. Expect several months for examination alone, and longer if objections or oppositions arise. If speed matters, an expedited examination request is available for a higher fee, which shortens the wait for the first examination report but not the four-month opposition window.

Common mistakes

Founders often file without a search, choose descriptive names that attract section 9 objections, file in a founder's personal name without later assignment, or miss the one-month reply window. Others use ® before registration, which is an offence.
