Form GST DRC-03: paying GST voluntarily or against a notice
DRC-03 is used to pay GST shortfalls voluntarily, after audit or against a notice. Paying before a notice can reduce or remove penalty.
Short answer
Form GST DRC-03 is the intimation used to pay tax, interest or penalty outside the regular return, for example a shortfall found while preparing GSTR-9, during audit, or after a notice. Paying before a show cause notice, or within the time allowed after one, can reduce or remove penalty. DRC-03A now links earlier DRC-03 payments to a demand order.

When do you use DRC-03?
GSTR-3B cannot be revised, so DRC-03 is the route for paying any amount you discover was short paid. Common triggers are reconciliation differences in GSTR-9 or GSTR-9C, excess credit found during internal or statutory audit, responses to discrepancy intimations in DRC-01B or DRC-01C, and payments against scrutiny notices in ASMT-10 or show cause notices.
You choose a cause of payment such as voluntary, annual return, audit, scrutiny or show cause notice, and the tax period. The portal issues an acknowledgement in DRC-04 once the payment is made.
DRC-03 is also the route for paying amounts that an officer points out during a departmental audit under section 65 or a special audit under section 66, where you accept the observation. Paying at that stage, with interest, usually avoids a formal notice for the accepted portion.
How paying early affects penalty
For demands relating to FY 2024-25 onwards, a single section, 74A, governs notices for both fraud and non-fraud cases. For earlier years, sections 73 and 74 continue to apply. The penalty saved by paying early is significant.
| Stage of payment | Non-fraud cases | Fraud or suppression cases |
|---|---|---|
| Before show cause notice, with interest | No penalty | 15% of tax |
| Within the time allowed after the notice | No penalty | 25% of tax |
| After the order is passed, within 30 days | Penalty as per order | 50% of tax |
Paying from cash or credit ledger
Tax shortfalls can generally be paid from either the electronic cash ledger or the credit ledger, subject to the order of utilisation. Interest, penalty and late fee must be paid in cash. Erroneous refunds and certain recoveries must also be repaid in cash.
Interest at 18% a year runs from the original due date of the return until the date of payment. Calculate it carefully and include it in the same DRC-03, because paying tax without interest leaves an open demand that can be enforced.
Where an amount was paid through DRC-03 by mistake, for example twice for the same period, it can be claimed back through a refund application, but this takes time. Check the liability register on the portal before paying.
DRC-03A and linking payments to demands
Taxpayers often paid through DRC-03 under the voluntary option even when a demand order already existed, so the demand stayed open on the portal. Form DRC-03A now lets you link such a payment to the demand order, and the demand is then reduced in the electronic liability register. Use it rather than paying the same amount twice.
Common errors and consequences
Common errors include selecting the wrong cause of payment, entering the wrong tax period, paying tax without interest, using credit to pay interest, and paying under the voluntary head when a demand already exists. Each of these can leave a liability open even though money has left your account.
Before filing, collect the working for the shortfall, the interest computation, and any notice reference. Keep DRC-04 with the reply you send to the officer. Refogo's partner professionals can compute and pay GST shortfalls through DRC-03 as part of notice handling.

Common questions
Can I pay DRC-03 using input tax credit?
Tax can generally be paid from the credit ledger, but interest and penalty must be paid in cash.
Does paying through DRC-03 close the matter?
For voluntary payments of tax with interest before a notice in non-fraud cases, no penalty applies and proceedings are concluded for that amount. Keep evidence and inform the officer where a proceeding is pending.
What is DRC-03A?
DRC-03A links a payment already made through DRC-03 to a demand order so that the demand is reduced on the portal.
Is interest compulsory on DRC-03 payments?
Yes. Interest at 18% a year applies from the original due date to the date of payment.
