AGILE-PRO-S Form INC-35: GST, EPFO, ESIC and Bank Account at Incorporation
AGILE-PRO-S (INC-35) is the mandatory SPICe+ linked form for EPFO, ESIC, bank account and optional GSTIN. Filed with Part B; no separate MCA fee.
Short answer
AGILE-PRO-S (Form INC-35) is a mandatory linked web form filed with SPICe+ Part B. It applies for EPFO and ESIC registration, opens a company bank account through a partner bank, and optionally applies for GSTIN and, in some states, professional tax registration. It carries no separate MCA fee and is submitted together with the incorporation set, after an OTP check on a director's mobile and email.

What AGILE-PRO-S does
AGILE-PRO-S is short for Application for Goods and services tax Identification number, employees' state Insurance corporation registration, pLus Employees' provident fund organisation registration, Profession tax registration, Opening of bank account and Shops and establishment registration. In practice it is the form that carries your registrations with other departments alongside incorporation.
It cannot be filed on its own. It is one of the linked forms in the SPICe+ set, along with e-MoA (INC-33) and e-AoA (INC-34), and it is uploaded in the same submission as SPICe+ Part B.
Which registrations are included?
EPFO and ESIC registration numbers are generated as part of incorporation. This does not mean contributions start immediately. Liability under each law depends on employee headcount and wage thresholds, but having the codes ready saves a separate application later.
Opening a bank account is mandatory. You pick a partner bank from the list in the form and the bank contacts the company after incorporation to complete its own KYC. GST registration is optional, and many advisers apply for GST separately after incorporation so that it does not hold up the company application.
| Registration | Status in AGILE-PRO-S |
|---|---|
| EPFO establishment code | Mandatory, generated on incorporation |
| ESIC registration | Mandatory, generated on incorporation |
| Bank account | Mandatory, choose a partner bank |
| GSTIN | Optional |
| Professional tax | Only where the state is integrated, such as Maharashtra |
Information and documents to keep ready
The form asks for the principal place of business, nature of business and details of the authorised signatory. If you opt for GST, give the place of business proof and details of the promoter who will authenticate the application. An OTP is sent to the mobile number and email of one proposed director, so that person must be available while the form is being finalised.
Keep the same registered office documents used in SPICe+ Part B. Any difference in address, PIN code or director details between SPICe+ and AGILE-PRO-S is a common reason for resubmission.
Common mistakes
Errors in AGILE-PRO-S rarely stop incorporation outright, but they can delay the GSTIN or bank account. Check that the business activity description matches the NIC code and objects in the e-MoA, and that the director chosen for OTP verification has access to the phone and email entered.
- Choosing GST without being ready for the GST officer's verification
- Mismatch between AGILE-PRO-S address and SPICe+ registered office
- Wrong state selected for professional tax
- OTP sent to a director who is not available
- Assuming EPFO or ESIC codes mean contributions are due from day one
Penalties and what happens after filing
AGILE-PRO-S has no penalty of its own because it is part of an application rather than a periodic return. Once the company is incorporated, the EPFO and ESIC codes and GSTIN (if applied for) are communicated by email. From that point each registration carries its own compliance, such as GST returns or ESIC contributions once the law applies. Refogo's partner professionals can file the full SPICe+ set, including AGILE-PRO-S, for a fixed fee.

Common questions
Is AGILE-PRO-S mandatory?
Yes. It must be filed with every SPICe+ incorporation, although GSTIN within it is optional.
Does AGILE-PRO-S register the company for GST automatically?
Only if you choose GSTIN in the form. Many founders skip it and apply on the GST portal after incorporation.
Do I have to pay PF and ESI as soon as I get the codes?
Not automatically. The codes are issued at incorporation, but contributions become payable only when the company meets the coverage conditions under each law.
Can I change the bank selected in AGILE-PRO-S?
The bank chosen receives your details for account opening. You can still open accounts with other banks after incorporation.
